Effective From: November 15, 2026 (Version 1.0)
This Fair Use Policy ("Policy") defines the acceptable use of certain Circularo Services and, specifically, it applies to User-Based Subscriptions with ‘Unlimited’ Transactions (as defined in the Terms of Service). This Policy is designed to ensure platform stability, prevent misuse and provide a high-quality experience for all users.
What is permitted fair use?
Fair Use refers to the reasonable use of Transactions. Fair use of the ‘Unlimited’ Transaction tier for User-Based Subscriptions involves routine, human-initiated, non-automated workflows. This means that Transactions must be initiated by a single authenticated Regular User through one of the official Circularo web or mobile applications or through an official productivity add-ins (e.g. Microsoft 365 or Google Workspace). A volume of Transactions, which in our experience, exceeds the nature, quantity and # of such Transactions is not fair use.
What is impermissible, unfair use?
Fair use excludes any automated, system-to-system processing, including the initiation of any Transactions or similar processing. The following activities are prohibited under any User-Based Subscription with an ‘Unlimited’ Transaction allowance:
-
automated, programmatic or system-generated Transactions;
-
API-triggered or script-driven executions, including by third-party integrations;
-
workflow automation and automated background processing; and
-
high-volume bulk or batch signing operations.
Each of these uses requires purchase of the REST API Access Add-On, with lower-cost, consumption-based pricing for high-volume automation available through the API eSigning / eSealing Transactions Add-On.
How do we address unfair usage?
Circularo may monitor the Service and your usage patterns to detect anomalies, automation bypasses or mass processing. This monitoring is undertaken in accordance with our Privacy Policy.
If your usage appears or becomes excessive, unduly burdensome or abusive, Circularo reserves the right to do any one or more of the following:
-
Issue usage warnings
-
Restrict or throttle further automated volumes
-
Quantify and apply reasonable use limits
-
Suspend your Subscription or access to all or part of the Services
-
Require the customer to migrate to a Transaction-Based Subscription Model or purchase appropriate Consumption-Based Add-Ons.
